1. Introduction
1.1 This End User Licence Agreement (“EULA”) is a legal agreement between you (“User”, “you”) and BLYMP LTD (“BLYMP”, “we”, “us”, “our”).
1.2 This EULA governs your use of any software application, mobile app, desktop program or game published by BLYMP LTD under the trading name BLYMP, whether free or paid, online or offline (collectively referred to as “the Software”).
1.3 By downloading, installing, or using any BLYMP Software, you agree to be bound by this EULA, our Privacy & Cookie Policy, and our Terms of Website Use available at blymp.co.uk.
2. Licence Grant
2.1 BLYMP grants you a non-exclusive, non-transferable, revocable licence to install and use the Software for your personal or internal business purposes, subject to these terms.
2.2 You may install the Software on your own devices and, where permitted, on devices owned by your organisation for legitimate business use.
2.3 You are not purchasing the Software itself, only a licence to use it. All intellectual-property rights remain owned by BLYMP LTD.3. Scope of Use
3.1 You may not:
copy, modify, reverse-engineer, decompile, or attempt to extract the source code;
distribute, rent, lease, sell or sublicense the Software to others;
remove or alter any copyright, trademark or attribution notice;
use the Software for any unlawful, harmful or fraudulent purpose;
attempt to interfere with BLYMP servers, security, or connected systems.
3.2 Where the Software connects to online services (e.g. myBLYMP, BLYMP Support Centre, or Matilda), your use must also comply with those platforms’ individual Terms of Service.
4. Account and Connectivity
4.1 Some BLYMP apps require you to log in using your existing BLYMP credentials. You are responsible for maintaining the confidentiality of those credentials and for any activity under your account.
4.2 Connected apps synchronise data through BLYMP’s secure servers. Data transfer and storage are governed by our Privacy & Cookie Policy.
4.3 Offline or standalone apps (for example, games) store data locally on your device. If you delete the app, any local progress or settings may be lost unless a sync feature is available.
5. Fees and In-App Purchases
5.1 Some BLYMP apps are free to use for clients with active BLYMP plans. Others may require purchase via an app store or in-app purchase.
5.2 Payments are processed through authorised app-store providers or BLYMP’s payment partners. Their terms will also apply.
5.3 Unless stated otherwise, all prices include VAT where applicable and are non-refundable except where required by law.
6. Updates and Changes
6.1 BLYMP may issue updates, bug fixes, or new versions of the Software. These may be installed automatically or may require manual acceptance.
6.2 BLYMP may modify or discontinue any feature at any time without notice. Continued use of the Software after updates indicates your acceptance of the revised version.
7. Data and Privacy
7.1 For connected apps, data (including login details, preferences, or usage logs) may be transmitted to and from BLYMP servers to provide functionality.
7.2 All data handling follows our Privacy & Cookie Policy available at blymp.co.uk/privacy.
7.3 BLYMP does not access, collect, or store any unnecessary personal data within standalone offline apps unless explicitly stated.
7.4 Some apps may use analytics to help us improve performance and user experience. These operate under the same privacy principles as our website analytics.
8. Intellectual Property
8.1 The Software and all related materials, including graphics, interfaces, scripts, and trademarks, remain the property of BLYMP LTD.
8.2 Nothing in this EULA grants you ownership of the Software or its content.
8.3 You may not reproduce or reuse any part of the Software for commercial purposes without written consent from BLYMP.9. Support and Availability
9.1 BLYMP aims to ensure that our Software remains secure and functional. However, we cannot guarantee uninterrupted access or compatibility with all devices.
9.2 Support is available through the BLYMP Support Centre at support.blymp.co.uk.
9.3 Some software, particularly free or beta versions, may receive limited or no support at BLYMP’s discretion.
10. Disclaimer of Warranties
10.1 The Software is provided “as is” and “as available” without warranties of any kind, express or implied.
10.2 BLYMP does not warrant that the Software will be error-free, uninterrupted, or suitable for your particular purpose.
10.3 You use the Software at your own risk.
11. Limitation of Liability
11.1 To the fullest extent permitted by law, BLYMP shall not be liable for:any indirect or consequential loss or damage;loss of profits, data, or goodwill; orany damage arising from use or inability to use the Software.
11.2 In any event, BLYMP’s total liability shall not exceed the amount paid by you (if any) for the Software during the twelve (12) months preceding the claim.
11.3 Nothing in this EULA limits liability for death, personal injury, fraud, or any matter that cannot be limited under UK law.
12. Termination
12.1 This licence is effective until terminated by you or BLYMP.12.2 You may terminate it at any time by deleting or uninstalling the Software.12.3 BLYMP may terminate this licence immediately if you breach these terms. Upon termination, you must stop using and delete all copies of the Software.
13. Export and International Use
13.1 You are responsible for complying with any local laws applicable to software downloads and data usage in your country.
13.2 All exports or re-use of the Software must comply with UK export laws and regulations.
14. Governing Law and Jurisdiction
14.1 This EULA is governed by and construed in accordance with the laws of England and Wales.14.2 Both parties submit to the exclusive jurisdiction of the English courts for all disputes relating to this EULA or the Software.
